IN THE MATTER OF THE APPLICATION OF ARTESIAN WATER COMPANY, INC. FOR A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO PROVIDE WATER SERVICE PURSUANT TO 26 DEL. C. §203C.

On October 9, 2020 Artesian Water Company, Inc., (“AWC”) filed an application with the Delaware Public Service Commission (“PSC”) for a Certificate of Public Convenience and Necessity (“CPCN”) to provide water service to the following tax parcels: eleven (11) parcels located on Delaware Street and are identified by Sussex County Tax Parcel Numbers 433-11.00-26.00, 433-11.00-27.00, 433-11.00-28.00, 433-11.00-29.00, 433-11.00-30.00, 433-11.00-31.00, 433-11.00-34.01, 433-11.00-34.02, 433-11.00-33.00, 433-11.00-32.00, and 433-11.00-24.00; and one (1) parcel located on Roxana Road and is identified by Sussex County Tax Parcel Number 533-10.00-49.00. The basis for the application is that AWC is in receipt of a signed petition requesting water service from the landowner in each proposed service area as set forth in 26 Del. C. §203C(e)(1)(b)(2).

The PSC will investigate this matter to the extent deemed necessary to determine whether a CPCN should be granted.  An evidentiary hearing on this application will not be held unless there is a meritorious request received within thirty (30) days of publication of this notice.  A meritorious request is deemed to be one which sets forth reasonable grounds why a public hearing would be appropriate or would be in the public interest.

Pursuant to current law, property owners within the proposed CPCN service area may file an objection to the issuance of a CPCN to AWC and may also choose to “opt-out” of inclusion in the proposed service area.  Written notice of such objection or a decision to “opt-out” of inclusion in the proposed service area must be sent to the PSC at the following address within thirty (30) days after publication of this notice. AWC’s application in this matter is available for public inspection at the PSC’s office at the address noted above during normal business hours, or through the PSC’s website at the following link: https://delafile.delaware.gov.
